Illinois Filing Deadlines & Comparative Fault Rules

Illinois law generally requires personal injury lawsuits to be filed within two years of the date of injury under 735 ILCS 5/13-202. For brain injury victims, this deadline carries real weight because building a case takes time: gathering medical records, retaining experts, and documenting the long-term impact of the injury all need to happen before that window closes.

In some cases, symptoms don’t become apparent until days or weeks after the accident. Illinois courts may apply a discovery rule that affects when the filing deadline begins to run when an injury wasn’t immediately apparent. Whether and how the discovery rule applies depends on the specific facts of the case. This is general legal information; individual circumstances and exceptions can change how any deadline applies to a particular claim.

Illinois also follows a modified comparative negligence standard under 735 ILCS 5/2-1116. A plaintiff found to be 50% or less at fault can still recover damages, though the award is reduced by their percentage of fault. A plaintiff found more than 50% at fault cannot recover. When a defense team tries to shift blame onto the injured person, that argument directly affects what compensation is available. We anticipate those arguments and address them as part of building the case from the start.
