Illinois imposes specific legal duties on any driver involved in a crash. Under 625 ILCS 5/11-401, a driver whose vehicle is involved in a collision resulting in injury or death must stop immediately at or as close to the scene as safely possible. Failing to do so is a Class 4 felony. If that driver also fails to report the crash to police within 30 minutes, the charge escalates to a Class 2 felony, or a Class 1 felony when the crash caused a death. A conviction for leaving the scene of an injury or fatal crash triggers mandatory driver’s license revocation by the Illinois Secretary of State.

Property-damage-only hit-and-runs carry their own penalties. Under 625 ILCS 5/11-404, striking an unattended vehicle and driving away is a Class A misdemeanor, punishable by up to one year in jail and a $2,500 fine. These criminal consequences can matter to your civil claim: a conviction or guilty plea by the at-fault driver may become evidence in your injury case.

How Uninsured Motorist Coverage Applies to a Hit-and-Run

When a hit-and-run driver can’t be identified, Illinois law treats that driver as an uninsured motorist for purposes of your own auto policy. Your UM claim is filed against your own insurer, not against the person who hit you. Illinois requires every auto policy to include uninsured motorist bodily injury coverage of at least $25,000 per person and $50,000 per accident, and that coverage can’t be rejected by the policyholder.

Evidence Preservation & Filing Deadlines After a Champaign Hit-and-Run

When the Hit-and-Run Driver Is Identified Later

A UM claim filed after a hit-and-run doesn’t close the door on other recovery options. If law enforcement later identifies the driver, you may have grounds to pursue a claim directly against that driver’s liability insurance, which can run alongside or replace the UM claim depending on how coverage applies. Evidence collected during the criminal investigation, including witness statements, the police case file, and any dashcam or surveillance footage, can strengthen your civil case.

One additional factor applies to all Illinois injury claims: the state’s modified comparative negligence rule. A claimant found more than 50 percent at fault for the accident is barred from recovering any compensation; a claimant found partially at fault below that threshold sees the award reduced proportionally.
